Masindi Municipality instructs lawyer to appeal against the withdraw of golf case


Masindi municipal council has instructed, Ian Musinguzi, from Musinguzi and Co Advocates to appeal against the withdraw of the case involving  Masindi Golf and sports Club, the Attorney general, Masindi district land board, Masindi Municipality and the commissioner Land registration.

The registered trustees being led by Oscar Baitwa,and  Pantaleo Kasangaki, drugged the four parties to Masindi high court in 2017 accusing  them of trespassing on Masindi golf land where by Masindi high court high court and Central division were allocated almost half an acre each.

The purpose of allocating them land was to establish a high court in Masindi district and construction of Central division headquarters.

However, appearing before high court which was being presided over by Masindi resident Judge, Paul Wolimbwa Gadenya, the Masindi Golf and sports Club  Registered Trustees  being Represented by, RichardAkuzigibwe and Ronald Murungi from Kabalega Advocates and legal consults told court that they had lost interest in the case in the interest of the people.

Akugizibwe also explained that the registered trustees had numerous discussions with the Attorney General, Masindi district land board, Commissioner land registration and Masindi Municipality and a consensus was arrived at that the matter be withdrawn.

Akugizibwe also told court that they agreed that the matter be withdrawn in the interest of peaceful coexistence of the parties and the general good of the sports fraternity of Masindi district. 

When the judge asked, Fredrick Bagonza Mandela, the LC3 chairperson Central division  also confirmed that they had had numerous discussions and agreed to withdraw the case adding that the division would meet the costs of the lawyer who was representing the Municipality since they have a running contract with him.

But Ian Musinguzi from Musinguzi and Co. advocates the lawyer representing Masindi Municpality insisted the plaintiffs meet the costs and demanded for 1.2 billion shillings which was rejected by the resident judge and accepted the withdraw of the case without costs.

However, according to the letter dated 9th, July 2020 authored by the Town Clerk Masindi municipality, Ketty Kashemire, Fredrick Bagonza Mandela the chairperson LC3 Central division  didn’t have any instruction and Mandate to appear before the learned Judge and withdraw the case without costs.

The same letter has instructed Ian Musinguzi the lawyer for representing Masindi municipality to appeal against the withdraw of the case.

When contacted Musinguzi confirmed receipt of the letter and explained that he was going to file the appeal today in the court of appeal.
